A Las Vegas Temporary Protection Order is applied for at the Temporary Protection Order located at the Family Courthouse. Additionally, when there is a police call to a location because of alleged domestic violence, the police may assist in putting the victim in contact with a victim advocate who will assist with making a telephonic request for a Temporary Protection Order. Many people in Clark County do not know that Family Court Judges take rotating shifts where they grant Temporary Protection Orders after hours and on the weekends. This service is done to ensure that victims received immediate assistance to avoid further altercation and delay.

A Temporary Protection Order or “TPO” as it is commonly known, results from a voluntary filing wherein someone has alleged domestic violence. Domestic violence is defined by the Nevada Revised Statutes at 33.018. It is important to understand the definition of domestic violence to under the TPO process.

The TPO Application Process, when completed through means other than an emergency a call is as follows:

  1. Obtain the TPO Application;
  2. Complete the TPO Application and return it to the TPO office located at the Family Courthouse;
  3. The TPO if granted, will either expire within thirty (30) days or be set for a hearing on a request to extend the TPO;
  4. If the TPO Application is not immediately granted, it may require a hearing wherein the person applying for the TPO, also known as Applicant, may make argument to the Court about the facts and circumstances requiring protection and the Court may grant or deny the TPO.

When a TPO is granted, the TPO requires that the person who committed the violence, also known as the Adverse Party, stay at least 100 yards away from the victim/Applicant and have no contact with the victim/Applicant. No contact means the Adverse Party should not approach or go to places where the victim/Applicant is located, the Adverse Party should not call, email or text the victim/Applicant. The Adverse Party should also not ask anyone to contact the victim/Applicant on their behalf. All of these types of actions are potential violations and may result in arrest and prosecution.

The TPO may be specific and include the address where the victim/Applicant is residing, their place of employment and places where the victim/Applicant may frequent. In some cases, the TPO may also grant temporary physical custody to the victim/Application and require the Adverse Party to stay away from the children including their school and/or daycare. It is important to understand, if you are the Adverse Party and served with a TPO, you must follow the specific instructions outlined in the TPO or you may be arrested and prosecuted for your violations.
